These Terms of Service (”Terms”) and Privacy Policy (”Policy”) govern your access to and use of IS IT PROPAGANDA?® (”IIP”, “the Publication”, “we”, “us”), a Substack-hosted newsletter focused on structural, non-ideological propaganda analysis. By subscribing, visiting, or otherwise accessing the Publication, you agree to accept these Terms in their entirety.

TERMS OF SERVICE

1. Acceptance of Terms

By accessing, subscribing to, or reading , you confirm that you are at least 18 years of age, have legal capacity to enter into a binding agreement, and agree to comply with these Terms. If you do not agree, you must immediately discontinue your use of the Publication.

2. Description of the Publication

is an independent newsletter dedicated to the structural analysis of propaganda techniques across media, political, and institutional communications. The content published is analytical, editorial, and educational in nature. It does not represent legal, financial, or political advice.

3. Subscription Tiers

IIP offers the following access levels:

• Free Tier: Access to selected public posts and the newsletter preview.

• Paid Subscriber: Full access to all published content, archives, and premium analysis.

• Founding Member: All paid subscriber benefits plus exclusive recognition and early-access content.

Subscription pricing and features are subject to change. Subscribers will be notified in advance of any material changes via email or publication announcement.

4. Payment Terms

All paid subscriptions are processed securely through Substack’s payment infrastructure, powered by Stripe. By subscribing to a paid tier, you authorize recurring charges at the selected billing interval (monthly or annual) until you cancel your subscription.

All prices are listed in United States Dollars (USD) unless otherwise specified. You are responsible for any applicable taxes or fees imposed by your jurisdiction.

ALL SUBSCRIPTION PAYMENTS ARE FINAL AND NON-REFUNDABLE.

No refunds, credits, or prorations will be issued for any reason, including but not limited to:

• Cancellation of a subscription before the end of a billing period.

• Failure to use or access the Publication during an active subscription.

• Dissatisfaction with editorial content or publication frequency.

• Account suspension or termination due to violation of these Terms.

• Technical issues or outages attributable to Substack or third-party services.

• Change in subscriber circumstances, including relocation, loss of access, or change of interest.

This no-refund policy applies equally to monthly and annual subscriptions, partial billing periods, promotional or discounted subscription periods, and all founding-tier memberships.

Exceptions may be considered solely at the Publisher’s discretion in cases of demonstrable technical error causing duplicate billing. Such requests must be submitted in writing within 7 days of the erroneous charge.

5. Cancellation Policy

You may cancel your subscription at any time through your Substack account settings. Upon cancellation, your paid access will remain active through the end of the current billing period. No partial refunds will be issued for the unused portion of any billing period.

After cancellation, your account will revert to the free tier. Cancellation does not entitle you to any refund of previously charged amounts.

6. Intellectual Property

All content published by , including articles, analysis, graphics, headlines, brand materials, and the registered trademark IS IT PROPAGANDA?® is the exclusive intellectual property of Jerry B. Marchant. All rights are reserved.

Subscribers are granted a personal, non-transferable, non-exclusive license to read and access content for private, non-commercial use. The following are expressly prohibited without prior written consent:

• Reproduction, redistribution, or republication of content in any format.

• Scraping, automated collection, or bulk downloading of content.

• Commercial use of any IIP materials, analysis frameworks, or brand elements.

• Training or fine-tuning artificial intelligence models on IIP content.

The registered trademark IS IT PROPAGANDA?® may not be used in any context without express written authorization from Jerry B. Marchant.

7. User Conduct

You agree not to use in any manner that violates applicable law, infringes upon third-party rights, or disrupts the integrity or operation of the Publication. Prohibited conduct includes, without limitation:

• Sharing paid-subscriber content with non-subscribers.

• Using the platform to harass, defame, or threaten any individual.

• Attempting to circumvent subscription controls or paywall mechanisms.

• Impersonating the Publisher or its representatives.

8. Disclaimer of Warranties

is provided on an “as is” and “as available” basis. The Publisher makes no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. The Publisher does not warrant that the Publication will be error-free, uninterrupted, or free of harmful components.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Jerry B. Marchant shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use , even if you have been advised of the possibility of such damages. The Publisher’s total liability to any subscriber shall not exceed the total amount paid by that subscriber in the 12 months preceding the claim.

10. Modifications to Terms

The Publisher reserves the right to modify these Terms at any time. Material changes will be communicated via email or publication notice at least 14 days before taking effect. Continued use of the Publication following such notice constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in New York County, New York.
